In India there is no bar on having homosexual relationships but marital union between same-sex couples is yet to be legalized. Homosexual orientation cannot be seen with the lens of shame. Every person has a right to live her life on their own terms so as the same-sex couples have. India is much away from providing them equal rights as given to heterosexual couples. There are insufficiency in legal system to accept the concept of same-sex marriage within its ambit. This research is discussing the effects of legalizing same-sex marriage vis-à-vis not legalizing same-sex marriage and whether Indian society accept same-sex marriage or not. If yes, then what changes may bring into Indian laws and if same-sex marriage may not be accepted then what will be the aftereffects of it. For legalization of same-sex marriage either a separate new law may be introduced or changes may be introduced in existing laws to remove the presumption of heterosexual character of marriage. This research intends to explore the scope of Indian laws with respect to legalize same-sex marriage and to examine the present scenario in Indian society.
