The lack of protective education to refugees in the way of meeting high end goals for refugees achieving durable solutions, and of sustainable development and reconstruction of home in host country. This is true for India which is home for refugees from diverse areas. Although, India is not a party to the United Nations Convention Relating to the Status of Refugees 1951 (1951 Convention) and the Protocol Relating to the Status of Refugees 1967, but has always been generous towards refugees. Under The Foreigners Act 1946, the government protects rights of refugees & asylum seekers. Further, it protects the rights provided under international customary law under Article 51 (c) of constitution of India. UNHCR through various local implementing partners provide assistance for refugee rights & educational development. The Indian Judiciary has played a very active role in implementing the right to education for refugees in India. Through this paper the author has analyzed the role of judiciary in refugee's rights & educational development protection with respect to India.
