Abstract

The primary object of this study is to observe the present legal position with respect to law of domicile in private international law. It makes analysis of the importance of domicile of dependent persons and kind of domicile and this present work aims of making analytical evolution of issues relating to concept of domicile and collects relevant literature or them.

It has been suggested that a domicile of dependency is simply a domicile of choice, but the two kinds of domicile differ in three respects. In the first place, a domicile of choice can, while a domicile of dependency cannot, be abandoned. Secondly, a domicile of dependency is, with one possible exception (i.e. a wife's first domicile on marriage) imposed, whereas a domicile of choice is always acquired. Thirdly, it is easier to prove that a formerly dependent person has abandoned his last domicile of dependency than it is to prove the abandonment of a domicile of choice.
