Abstract

Diplomatic protection is a function of the sovereignty of States under international law within the framework of their mutual rights and obligations in the international community. It is traditionally an inter-State practice. In precise language, diplomatic protection can be defined as a procedure for giving effect to State responsibility involving breaches’ of international law arising out of legal injuries to the person or property of the citizen of a State. With the expansion, in modern times, of economic and commercial intercourse between nations, diplomatic protection evolved into a rule of customary international law. “It is an elementary principle of international law.
