By referring to the opinions of precedent and modern jurisconsult about sale by Moatat and consent, two different approaches were discussed with their advocators. First approach indicates a kind of using words not considering means for declaring will and shows importance of words in binding contracts. Second approach, which begins from the time of Mohaqeq Ardabili, departs from severe wordings of past periods and considers every conventional means sufficient for contracts. This approach does not recognize any necessity and features for words and considers these means as indicators of internal will and a way for discovering sensual validity.
