Illegal Digging and Exploitation of Water Wells from The Viewpoint of Islamic Jurisprudence and Iran's Law

The religion's viewpoint toward water is a sanctimonious one, just as Anahita, the water's pure angel in Iranian culture, is not an anomalous word. Iran due to locating on the world's dry belt is one of the drought countries. Our ancestors for confronting this challenge tried to take underground waters to the cities by digging wells and subterranean water canals. Undoubtedly, at the present time, the status of aquifers of underground water has become worrisome thanks to unmethodical entrance of impermissible wells. According to jurisprudence teachings, any exploitation of waters which make losses, is unlawful, and from the juridical viewpoint, any use of underground waters by digging wells and subterranean water canals requires a permit in such a way that illegal digging and exploitation of water's resources is a criminal act. This research by the use of descriptive-analytical method seeks to clarify the status of illegal digging and exploitation of water's in confronting with illegal digging and exploitation of water's wells.
