Patients’ rights charter aims to defend human rights in order to maintain their dignity and reverence to ensure at the time of illness, and medical emergencies in particular, they will be taken care of sufficiently without sex, age, race, etc discrimination and with or without ability to pay for health care. This research aims to study patients’ rights and to present appropriate tactics in resolving shortages of the charter. Through studying patient rights in Iran and in France, we found that patients have some rights such as, receiving acceptable health services, being informed of their illness and treatment, free choice and decision making, access to medical file, and confidentiality of their medical secrets, and patient complaint responding system. Notwithstanding, some differences have been observed between patient rights in these two countries the most important of which is that in France patient rights have been developed and passed as a separate and special law, but in Iran, these rights have been notified to and are available in the health centers which seems to be not efficient in informing every body of their rights, a weak point for patient rights in Iran, which contributes rights of some patients to be violated.
