Abstract

Judge is the person who parties to a contract refer to him for solve possible disagreements obtained from that contract. So parties can agree to accept either independently of contract or as judgment provision which in case of possible disputes in implementation of the proposed contract they can refer to judge. Judgment has different types according to various credits such as international and internal Judgment, organizational and case judgment, optional and compulsory judgement. How to choose the referee is one of the most important issues that Iranian legislators had paid attention to it. And according to the laws of Iran parties can choose a judge before happening conflicts or after that and determine the number of judges. However determine judge before conflicts is more comfortable because there is no gap still between parties. In this article we have tried to examine and provide mentioned cases from the view of Iranian law.
