Conceptualising of Judicial Activism Regarding Capital Punishment in India: An Analysis

From the beginning of human civilization the issue of crime and punishment has been an issue which has been discussed by numerous philosophers. Wherever there is human settlement governed by rules, there will be some action or omission that will fall under the category of crime. Crime is bound to happen in a society because somewhere someone will break the set rules that govern the society. This paper will discuss the role and activism shown by the Apex Court while dealing with the concept of Capital Punishment.
