Increasing damage cases in international marriage victim counseling in South Korea: Limitations of the revised marriage brokers business management act

This paper focuses on increasing damage cases to international marriage partners caused by marriage brokers, even though the Marriage Brokers Business Management Act in South Korea has been revised several times, and the purpose of paper is to analyze the significance of the problem and present an alternative at the conclusion. The research method of this paper is based on literature analysis, deals with the revised Marriage Brokers Business Management Act and uses a method of collecting and analyzing various documents such as journal articles, proceedings, government reports, news releases, websites, newspapers, issue papers, and formal statistics to confirm an increase in cases of international marriage damage counseling caused by marriage brokers after the revision of the law. The Korean government has enacted a law to strengthen morality by imposing restrictions on the qualifications of marriage brokers, but this law has the pitfalls of exposing the aforementioned limitations and aggravating the situation. Marriage brokers who are struggling with loss of profits as the government strengthens regulations will ultimately seek ways to escape regulation. In the end, the damage still goes back to the consumer, the system user. Therefore, this paper concludes with two suggestions. First, there is a need to further strengthen the qualifications and punishment provisions or take special measures. Second, It is necessary to consider the solution that Taiwan government stopped commercial marriage brokers that have been causing camouflage marriages and fraud marriages, and delegated non-commercial marriage brokers business to civil organizations. Despite the steady decline in the number of international marriage brokers in Korea since 2007, follow-up studies are needed to find out the cause of the problem of the increasing number of victims and to prepare specific alternatives for strengthening punishment regulations
