Abstract

Hope for survival is an intrinsic matter for humans. This is indeed deemed as a kind of perfection for them. Nowadays scientific advances have made fertilization of humans and animals through ways other than intercourse feasible. In vitro fertilization, i.e. fertilization outside the womb, without legal or illegal intercourse, and intrauterine fertilization through implant or insemination are among newly emerging issues raised due to time advancement and scientific developments. Artificial embryo generation and transmission into the uterus are among important issues discussed in different countries in terms of medical, ethical, religious, social, psychological, and legal aspects, and some laws have been enacted in this regard. In Iran, embryo donation to infertile couples was ratified by Islamic Consultative Assembly in 2003 which has made a development in the Iranian laws, though it is very imperfect compared with law of France and other developed countries. This paper aims at studying modern methods of human production from the perspective of law and Islamic jurisprudence by virtue of contemporary jurisprudents decisions and Iranian laws, particularly the new law.
