Nuclear terrorism from the perspective of International criminal law

Abstract

One of the most challenging terrorist acts is "Phenomenon of nuclear terrorism” that is committed in this century using modern weapons of mass destruction. Therefore, undoubtedly the shadow of nuclear terrorism is felt today more than last years, because international fundamentalist people know the power of these tools and they want to obtain it as a major and preventing factor and attack against their targets and enemies. This paper will examine nuclear terrorism, types of nuclear terrorism, cases that happened in the world, as well as proceedings of international criminal law to deal with it, It seems, though, compared to other new forms of terrorism, acts of nuclear terrorism occurred less, but because of the possible devastating and widespread consequences of it on human societies, we need to develop and establish practical and effective legal mechanisms for dealing with it. International legal measures in this regard include: the Convention on the Physical Protection of Nuclear Material, Vienna on 3 March 1980. Resolutions (1540, 1673, 1810 and 1887). Acts of International Atomic Energy Agency are Security Council between 2004 and 2009, the International Convention to Combat Nuclear actions in April 2005, and. Although in recent decades the legal efforts of the international community in the fight against various forms of terrorism (especially nuclear terrorism) cannot be ignored, because these actions somewhat Prevented the occurrence of this type of terrorism, but so far it seems that all the actions taken in the establishment and implementation of codified legal mechanisms, were not effective. Therefore it is necessary to confront and eliminate terrorism that forms of doing it are being increased, International legal documents, including comprehensive legal definitions that is acceptable to the international community, should be developed. The research in this paper is based on a content analysis and documentary study.
