Abstract

Doctor belongs to a medical profession, which from time immemorial is revered to as a noble one. He enjoys an unique position even in today's litigant society that has placed him almost on par with the God. It is not just because he has a medical qualification but because of his dedicated services and his untiring selfless duty towards the suffering of humanity in need. Every professional is ethically bound by the oath he swears by before entering professional career, any deviation there from is considered as unethical. As per the oath, every registered medical person is expected to help the suffering human to the best of his ability. But at times, he comes across a situation when he is cornered not knowing whom to turn to because of the judicial compulsion. He, as an individual, neither dares to go against the Law of the land nor his ethical conscience does permit him to act as per the proceedingsa doctor in dilemma indeed! A typical situation is the capital punishment in the execution of which he has a legal binding to participate/prepare, assist the executioner and examine the executed individual to pronounce death!! Modes of execution of capital punishment vary from country to country. There have been divergent views concerning the ultimate punishment itselfwhether it is to be practiced at all.
