Abstract

Indian Penal Code S. 302, Indian Evidence Act s. 60, Criminal Procedure Code s. 293(4) - Post mortem report - Evidentiary value of post-mortem report - Murder causedby inflicting injuries - Doctor who conducted autopsy over the dead body not examined - It caused prejudice to defence - Defence got no opportunity to cross-examine him on account of nature of injuries and whether they were sufficient to cause death in ordinary course - Contents of post-mortem report could not be proved by examining compounder of hospital - Post-mortem report is not a document which falls under section 293(4) CrPC.
