DNA Profiling Bill 2007 and the future of paternity disputes

Abstract

DNA Profiling is receiving recognition as a highly accurate means of scientific evidence; the Profiling Bill of 2007 espouses setting up Data Banks all over the country with such safeguards as to prevent privacy concerns. One of the most apt applications of this technique happens to be resolving paternity disputes; however the bar against disproving the Presumption of Legitimacy of a Child as granted by the Indian Legislature through Section 112 of the Indian Evidence Act may be disproved by limited means. Until the position of law changes, paternity being disproved is a difficult issue with or without scientific aid. However, considering the intent of the Legislature to prevent Illegitimating a child, it is observed that some things are better left unchanged.
