Trips agreement and protection of new plant varieties: Issues and implications for agricultural sector in India

Abstract

In today's era the protecting new plant varieties has gained general acceptance throughout the world. The TRIPs agreement introduced intellectual property law into the international trading system for the first time and remains the most comprehensive international agreement on intellectual property, TRIPs has a powerful enforcement mechanism. It is clear that the Protection of Plant Varieties and Farmer's Rights Act, 2001 introduced in compliance with the provisions of TRIPs agreement have a strong bias in favour of modern plant breeder.

It reflects the trends towards the shift from common property rights regime to private property rights regime. The significance attached to the protection of plant varieties is not only limited to providing incentives to the plant breeder but also for the development of agricultural sector. The present paper deals with issues and implications for agricultural sector in India. It also discusses the trips agreement and protection of new varieties.
