Some reflections on legal control over medical negligence under consumer protection act 1986 of India

Abstract

The services of medical practitioners are covered and the term services are in the consumer protection act 1986. Indian medical association vs V.P. Shantha & others is a very good and landmark judgment in this respect. It has become the necessity of the hour for there is numerous example of negligence by doctors. But some people feel that the applicability of the C.P. Act to the medical profession is not a good sign which would in turn pose a member of challenge. This research paper critically examines the adeptness of the judicial pronouncements to the provisions of consumer protection in 1986.
