Abstract

The death penalty remains one of the most debated issues within the realm of human rights, sparking discussions regarding its legality, ethical foundation, and effectiveness. This essay delves into the human rights considerations associated with capital punishment, analyzing arguments for and against it from global and Indian perspectives. It examines the Indian legal framework, key international human rights treaties, and notable case studies referencing the Bharatiya Nyaya Sanhita (BNS). The essay concludes by exploring alternatives to capital punishment, emphasizing solutions aligned with human rights values, such as life imprisonment and restorative justice.
