The criminal justice system is inclined towards the accused. Various statutes protect the rights of criminals; for instance, the offender has a Constitutional right to be given information regarding the arrest grounds and also has the right to consultation, and he can also be defended by any advocate of his own choice under Article 22(1) of Constitution of our Country. During the trial, the benefit of the doubt always goes to the accused and the Victim, despite having suffered victimization, remains neglected.
Victims are merely treated as a source of information during a crime investigation, enabling the police to arrest the culprit or collect evidence. In the Court, the Victim is a witness for the Prosecution, resulting in his suffering as victims seldom attract attention; on the contrary, the offender has many rights and privileges during the entire process of criminal justice before and even after his conviction.
This paper will research victimology and victims' rights and how the victims are treated in the country's justice administration system. The research also aims towards the victims of crime and recent laws passed as special provisions for victims and amendments in the Criminal Procedure Code 2008 and Criminal Law Amendment 2013.
