Abstract

As a member af World Trade Organisation, India adopted significant changes to its Patents Act in 2005 making it compliance with TRIPs agreement. Since then several cases have been decided by the judiciary relating to different aspects of Patents Act, 1970. An attempt has been made in this article to summarize some of the decided cases to enable the reader to know how laws have been applied in regard to patent infringements. Therefore, it becomes pertinent, before entering into the judicial stand, some basic concepts relating to "Patent Infringement" are properly understood.
