This article reviews the evolution of international human rights and criminal law regarding the responsibilities and liabilities of private corporations during armed international or domestic conflicts. It argues that international humanitarian law should be applied to monitor corporate behaviour in conflict areas, and to mandate due diligence and risk assessment from business leaders and their legal advisers, even when there is no formally declared war, but where social instability and institutional weakness expose civilian populations to adverse impacts resulting from profit-making activities.
