Abstract

The role of the law is limited in a society if the ethical values are strong, and the society remains united. Man prefers to live in a society and there is a ssrong bond of trust/faith/unity among the people. Diminishing ethical values due to lack in faith and breach in agreement are the major reasons of disintegration of the society. The sams is applied in medical and health sector, therefore the law has made a comfortable position in health sector also. Growing complexities in health care industry such as medical negligence & malpractice and industry outcome evaluation such as quantity, quality, costt and pattent's satisfaction have further facilitated the introduction of consumer protection act in health sector in 1993. Ultimately when the laws are framed, they are considered to be unbiased and applied oonealth sector which directly/indirectly affect the health care providers (HCP). HCPs deal with human being/body, and face many situations to deal the lives but some times law does not permit or if permitted, strong ethical values do not. Therefore the whole industry is in dilemma and afraid of unwanted consequences in the form of litigations/professional liabilities. But at the same time, there are many ways and means to prevent the professional liabililies and HCPs are well protected.
